Published the book “La tokenización de bienes en blockchain: cuestiones civiles y tributarias”, Thomson Reuters Aranzadi

The UNESCO Housing Chair has recently published the book  “La tokenización de bienes en blockchain: cuestiones civiles y tributarias” [The tokenization of goods in blockchain: private and tax law issues] (Thomson Reuters Aranzadi, 2020), which derives from the research carried out within the framework of the “Collaborative Housing” project (Ministerio de Economía, 2018) and the project “The tokenization of real rights in the regulation of the fifth book of the Catalan Civil Code” (CEJFE, 2019).

The present work is dedicated to the study of the legal consequences of the representation of the ownership and other limited real rights in digital tokens that operate in a blockchain. This technological practice makes it possible to represent a certain right (for example, the ownership of a home) in a digital token, which can be negotiated in an agile or even automatic way, thanks to smart contracts, while it is registered in a cryptographically protected distributed blockchain. This makes possible, at least theoretically, a faster, affordable and transnational transmission of goods. However, this system presents some challenges for our private and tax law system.

Commission for the Regulation of Rents of Barcelona City Council

Prof. Nasarre, director of the Housing Chair, took part last July 7 as an expert in the second session of the Non-Permanent Commission for the Regulation of Rents of Barcelona City Council, dedicated to international experiences on the subject.

The Commission was approved by the Extraordinary Plenary Council on Housing of Barcelona City Council last July 2019. The purpose of this commission is to discuss and study the need, convenience and possible impacts arising from the application of a regulation. of rental prices in the city of Barcelona.

Publication of an article about the effects of the crisis on condominiums

Prof. Dr. Sergio Nasarre and Dr. Héctor Simón have published the article “The effects of ten years of crisis in condominiums” in the Revista Crítica de Derecho Inmobiliario (No. 778, 2020), which deals with the effects of ten years of economic crisis in condominiums through the data collected from 1,202 surveys conducted in Spain to units’ owners residing there. The results show that ten years of economic crisis have affected the maintenance of condominiums, with a special incidence in the increase of the delinquency, at the time that has favored the origination of problems of cohabitation. A series of recommendations are formulated to improve the management, administration and finance of condominiums, as well as about the way to face the problems and the conflicts among residents, the actions in the field of universal accessibility and energy efficiency and the regime of housing tenures.
